While I agree it was somewhat negligent on the girls part for not watching where she was going. But I would say it was GROSS negligence on the part of the workers who left it unattended. Whle the girl was only scratched up good, what would have happened if it had been a small child playing on the sidewalk. We all know many times small children don't always watch where they are walking or running.
I would say that mother NEEDS to file a lawsuit if for no more reason than to teach the city/county to hire more responsible workers than what those were, to prevent some small child from being injured or worse.
