I would say that mother NEEDS to file a lawsuit if for no more reason than to teach the city/county to hire more responsible workers than what those were, to prevent some small child from being injured or worse.
Dependent upon your definition of a small child....mine would be that a responsible adult or older child would be with that child. Sidewalks are next to, or only separated from the roadway by a swale of maybe 3 feet or so. I wouldn't expect a small child to play or walk or run on a sidewalk next to a street unattended.

I also remain firm about no lawsuit in this case. Strong discipline on both parts. As a matter of fact, I'd be willing to bet that had there been discipline, rules, and regulations on both parts, this would not have happened. Teaching on the part of the mother needs to start at home, not in a court.
