Yes, it would be descrimination, but it would be LEGAL discrimination......no where in the law does it say that any team would be 'forced' to hire him. They can choose to or not, and not give a reason and it would be perfectly legal (as long as it was not due to race, religion, origin, etc which are protected classes). Teams just cut rosters this week and they do not have to justify why anyone didn't make the cut.
