she just moved into an apt and I find out that there is a sexual predator convicted of a lewd and lascivious crime with a child between 12-15!!!

I am horrified and my sister who is 25 doesn't seem to be bothered!

How can an apartment manager RENT to a SM w/ 2 kids knowing what they know????????

Do you know the manager knew? Are there laws in that area that managers need to inform prospective tenants? If not, then she's probably stuck. It certainly pays to research the predators in a certain area before signing a rental agreement. I'm w/ you, I'd be very, very concerned.

She lives in Jacksonville, Fl and is about 6 hours away from me and the rest of her family.

I don't think landlords here have to disclose that kind of info unless they are asked outright about it. We were fearing something similar because the man who lived next to my grandpa was convicted of attempted sexual assault on a child. We knew that once grandpa died, selling his house would be hard with a neighbor on the sexual predator list and we aren't the kind of people who could sell to a family and not disclose that info. Luckily, the guy moved out (never sold the house but moved out) and so he doesn't show living there anymore on the list.

*I* would be concerned if I were your sister and I would look for another place and RESEARCH the sexual predator list BEFORE committing to a place. That said, she probably doesn't have an out on her current contract so she'll have to pay that and for a new place which would suck. If she's not bothered you really can't do anything I don't think.

If the landlord/rental office did not know, he/she should have. On the rental applications, there is a box that asks "have you been convicted of a felony". If he checked it and explained his reason, rental agent knew. If not, there is a problem and I think I'd bring it to their attention. He could get evicted for not disclosing that.

I am perplexed that your sister is not concerned. The notifications are not to deter the predator, but rather warn those around the predator. If your sister is not vigilant and taking action to insure the kids safety, they are possibly at risk.

Does Florida have a Tier or Level system for Sex offenders? If so, what is this guy? Those systems usually rank an offender based on how likely they are to re-offend. And in some states a lewd and lascivious act could be something like an uncle showing his 15 y/o nephew porn and the kid's parents filing charges.

I don't know that the apt. mgr. has a legal obligation to inform prospective tenants that their is a sex offender living in the bldg/complex. And, by the same token, I don't know that the apt. mgr can discriminate (legally) against a convicted sex offender or any convicted criminal.

Do you know anymore information? Like the guys age. Could it be an 18 or 19 year old guy having sex with the 15 year old girlfriend? Not right, but girls do lie about their age and most these days look older than they are. Not that this makes it right, but maybe if you get more details then the situation might not be as bad as it sounds. Of course it could be worse than it sounds, he could be a habitual offender that has been in and out of prison. Most states have a website that you can lookup offenders and sexual offenders, there is a free website I can't remember the particular site, but I know when I want to look something up I google Oklahoma prisoners or something to that effect and it brings up the website that has links to all the states where you can look up prisoners, which will show whether he's been in prison, for how long and for what crimes, it should also give his PO and their phone number when they are out, ours does anyway. You might be able to call and talk to his PO and get information, they might not be able to give you details of previous but they can certainly tell you if you have reason to be concerned.

The sad fact is that MOST child sexual predators have never been convicted AND they are most likely someone you know. Of course your sister should absolutely be on guard at all times, but the reality is that they are everywhere.

if you do a search, there is another one in the complex as well. But, this guy lives above her.

I also had an offender live above me. When I asked in our office I was told that they could not limit where the offender can live nor can they refuse them (if they can prove that they can pay the rent) BUT those that live in our complex are not placed in buildings with young children (if that was the charge). My building did not have young children and when my little nieces and nephew are over they were not left outside alone.

Tell your sister to figure out a way to get out of this complex without paying out the nose... I live in Jax Beach and was wondering what part of town she was living in. This is a pretty decent area but apparently this is the apartment complex that has a rather shady crowd living in it.

She's so young, 24 and refuses our help. My family can be a bit too much for her,at times.
Since she was a teenage mom..she's trying to prove alot right now.

We have one living up the street, and there really isn't anything we can do about it, but, be vigilant in keeping our kids away. I do, however, see kids over there often, seems he has a few, and has a girlfriend with some......what a mess.

Allinaugust - Click on it a few times and you'll see the one guy. Last name Williams. Fortunately, he is not identified as a predator (more likely to re-offend) and he is not on supervision (if that indicates threat level).

If your sister is set on staying there and proving herself, maybe provide her with some personal and property protection items. (locks, mace, whistle, flashlight, etc)

(4) LEWD OR LASCIVIOUS BATTERY.--A person who:

(a) Engages in sexual activity with a person 12 years of age or older but less than 16 years of age; or

(b) Encourages, forces, or entices any person less than 16 years of age to engage in sadomasochistic abuse, sexual bestiality, prostitution, or any other act involving sexual activity commits lewd or lascivious battery, a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

If I were you, I would call the Duval County Prosecutor's office, and find out if he is on probation. If so, contact the probation officer, and speak to him/her regarding the conditions of this person's probation. I would be concerned, but, just think of how many people are not registered, and do this sort of thing. Scary.

1 was in for battery on a girlfriend
1 is in on some sex charges between him and ex girlfriend and some kinda religious cult
and my uncles ex brother in law gets in prison for drug charges, he never does anything always the other persons fault
