Do you know the manager knew? Are there laws in that area that managers need to inform prospective tenants? If not, then she's probably stuck. It certainly pays to research the predators in a certain area before signing a rental agreement. I'm w/ you, I'd be very, very concerned.

I don't think landlords here have to disclose that kind of info unless they are asked outright about it. We were fearing something similar because the man who lived next to my grandpa was convicted of attempted sexual assault on a child. We knew that once grandpa died, selling his house would be hard with a neighbor on the sexual predator list and we aren't the kind of people who could sell to a family and not disclose that info. Luckily, the guy moved out (never sold the house but moved out) and so he doesn't show living there anymore on the list. *I* would be concerned if I were your sister and I would look for another place and RESEARCH the sexual predator list BEFORE committing to a place. That said, she probably doesn't have an out on her current contract so she'll have to pay that and for a new place which would suck. If she's not bothered you really can't do anything I don't think.

| If the landlord/rental office did not know, he/she should have. On the rental applications, there is a box that asks "have you been convicted of a felony". If he checked it and explained his reason, rental agent knew. If not, there is a problem and I think I'd bring it to their attention. He could get evicted for not disclosing that. I am perplexed that your sister is not concerned. The notifications are not to deter the predator, but rather warn those around the predator. If your sister is not vigilant and taking action to insure the kids safety, they are possibly at risk.

Do you know anymore information? Like the guys age. Could it be an 18 or 19 year old guy having sex with the 15 year old girlfriend? Not right, but girls do lie about their age and most these days look older than they are. Not that this makes it right, but maybe if you get more details then the situation might not be as bad as it sounds. Of course it could be worse than it sounds, he could be a habitual offender that has been in and out of prison. Most states have a website that you can lookup offenders and sexual offenders, there is a free website I can't remember the particular site, but I know when I want to look something up I google Oklahoma prisoners or something to that effect and it brings up the website that has links to all the states where you can look up prisoners, which will show whether he's been in prison, for how long and for what crimes, it should also give his PO and their phone number when they are out, ours does anyway. You might be able to call and talk to his PO and get information, they might not be able to give you details of previous but they can certainly tell you if you have reason to be concerned.

The sad fact is that MOST child sexual predators have never been convicted AND they are most likely someone you know. Of course your sister should absolutely be on guard at all times, but the reality is that they are everywhere. I would point her to a copy of this book, Protecting The Gift . | It has been my understanding that as long as you are not using the info. to harass the offender, you can "publicize" it, so I would say yes.

I also had an offender live above me. When I asked in our office I was told that they could not limit where the offender can live nor can they refuse them (if they can prove that they can pay the rent) BUT those that live in our complex are not placed in buildings with young children (if that was the charge). My building did not have young children and when my little nieces and nephew are over they were not left outside alone.

Tell your sister to figure out a way to get out of this complex without paying out the nose... I live in Jax Beach and was wondering what part of town she was living in. This is a pretty decent area but apparently this is the apartment complex that has a rather shady crowd living in it. If I were you, I would call the Duval County Prosecutor's office, and find out if he is on probation. If so, contact the probation officer, and speak to him/her regarding the conditions of this person's probation. I would be concerned, but, just think of how many people are not registered, and do this sort of thing. Scary.
