It's illegal for them to take the money our of your check and then not use it for paying the insurance I believe. Personally I would be looking for a new job if he can? It doesn't sound like this one is going to last anyway and I would rather be in comtrol than not know what will happen next. ANd reschedule all appointments until you know what's going on unless you can get them in in the next 2 days. Good luck!

Did the company take the money out of your DH's check? or did you take the money out of the check? If they took the money and it was specified for Insurance Premiums then they need to provide the insurance, and if they don't I believe it would be considered some type of fraud.....I hope you can get things worked out.... A basic Dr. Apt only runs $70 here. That is for a sick visit with a physical running $120. I know that is a lot of money but it is probably less then what they take out of his checks. However the surgery is a different thing. Is there a way to get emergency medical from the state? I would look into that. Also call your insurance provider and maybe they can help you get a cobra plan.

op call the health insurance company directly and inquire about your policy and if the payments were made, if/when it is up for cancelation...if your dh's employer is not paying the health co, they can cancel the plan as long as they follow state law for timeframes/notification etc - Here is a link to your state insurance code - Insurance Code and scroll to Title 8 - Health Insurance and other Health Coverages you can contact the state insurance dept to report violations. but more importantly make sure you are covered and will be covered in the future. good luck - |

I called the texas dept of insurance, and they said they cant help. They said the employer has the right to offer insurance or not. If they dont offer it, then I have to find it somewhere else. well, that didnt help me I called the insurance company UHC, and they said they can only tell me if I have current coverage, not if the premiums were met or not. They said I can call back and see if I have coverage in a day or two. Otherwise I have to call HR dept to check. There is no longer a HR dept at his company. Now what?????????????/

Tomorrow I would call the TX Department of Insurance back and try again. Forget your first call, start over. Their job is to regulate insurers and I think maybe you need to get past the person who answers the phone. Be clear this isn't about if the company has to offer insurance, that it is about a company that does actively provide insurance and yet you have been dropped. Do you have pay stubs showing insurance withholding? This would be in your favor. Again, the best of luck. It is such a hassle for the little guy to deal with the machine. dl |

Department of Labor, Wage and Hour division possibly. Insurance Commission is not going to step in on this one. It's an employee/employer issue. If they took the premiums out of his check with the understanding that they were for the insurance then they have committed fraud.
