Question-Teens w/Permit & Insurance

Well my husband's Aunt/mother/cousins had a scary trip today. They went out for lunch, and the 16 yr old cousin ran a red light (says he didn't see it) and apparently got hit really hard by another car. It launched their vehicle quite hard, and tipped it on it's side and went skidding down the road some. They had to use the jaws of life to get the 4 of them out. Apparently everyone is ok except my hubby's aunt, is still on the hospital, although I am not entirely sure what is wrong. We aren't very close, and apparently details are changing depending on who you talk to. Now, *knock on wood* I have never been in an accident, nor really known anyone close enough to talk about the details-who has either.

I am curious of two things. One, even though it is completely their fault, could they possibly get any monies (hopefully to at least pay for medical bills)? Two, I'm almost positive the nephew is not on the insurance policy. I do *think* that NY is a state that they are automatically covered, but not sure? Any ideas on that one either.

Considering how bad it sounds, I think they are going to be OK, but we've heard that the Aunt might have a factured vertabrae in her neck, and this is a lady that is quite disabled already (physically).

Money from who? the cousin ran the red light, the other car had the green? I'd think the aunt would only be getting bills handled by her medical insurance not the person from the other car

I would hope that the insurance on the car the cousin was driving would cover the medical costs.
When my son had his permit and was under 16 he was covered by my policy and didn't cost anything.
Once he truned 16 we had to start paying for him even if he just had his permit.

The car is insured not the driver. If you lent your car to a friend and they did the same thing your insurance would cover the costs up to your policy limits.

I would think medical bills would be covered - but the vehicle may be another story. It will probably depend on whether there was full coverage or just liability on the vehicle.

Another thing that the situation depends on, is how much the personal injury limits are under the car's policy. We learned a hard lesson on this one when we had 10,000/20,000 limits on DD's insurance. She was involved in a 4 car accident with her being the last car. All three people in the chain claimed injury and they all wanted $10,000 each from our insurance. Well, with a 10/20 limit you can only get $20,000 per accident, it doesn't matter how many folks are involved. It was eventually settled, but it took 6 months and a lot of sleepless nights on my part over whether or not we would be personally sued!

Needless to say we've since upped our coverage!
