Post Finally filed our civil suit against Gino Moya aka Humberto Moya

Well, we finally filed our civil suit against Gino Moya aka Humberto Moya of Creative Development Network, Inc.

A huge thanks to everyone for bearing with me during my drama - especially IrishBlonde and everyone else that had to kick me in the rear to finally get me to wake up and smell the (alleged) SCAM!

If anyone wants, you may view our civil complaint at Case Information 7.1

Just search for the case by Moya and either Gino or Humberto for the first name. Our case number is RIC 502377, just leave off the letters if you search using the case number. We also turned him to several investigating authorities in CA, WA and NV. The criminal side takes a little longer.

I'm also looking into whether or not I can publish the emails that he sent us on a website. Especially the one where his wife, Julie Moya, tells me that her husband, "Gino has spent his entire life helping others as a pastor, counselor, and therapist" and in the same email states that our "funds will be returned as soon as the appropriate interest is gained." and she also claims that they are not to blame for "problems that we are having." Gee, let's see, having someone allegedly scam us out of $160,000 can cause a lot of stress and it's my opinion that they are to blame for a whole lot of problems that we are enduring - financial and stress related.

I hope everything works out for you... I was scammed out of alot of money myself by a family member and there was nothing I could of done about it... I hope you get all you are supose to get back and then some for the trouble you are going thru

Just curious as to what your contract with them said is "appropriate interest"?

Do your lawyers say that it is okay to be discussing this publicly?

I don't know a lot about the law but I always have thought that during litigation, matters are to be kept private unless the court says that it is okay to take it public.

Inquiring minds want to know! and you certainly don't want to ruin have your case thrown out by going against the mandates of the law.


Hoping that everyone gets their just reward when this is over -- I feel for you!

I'm not too stressed with discussing it publicly - I believe that I am protected against slander by the 'absolute defense' as long as what I am saying is the truth- it is and I would love to prove it in court - if a slander suit ever arises. And, if I speculate, then I must state that it's my opinion so there is no confusion (my right to free speech).

I am alleging the following:

Our contract never mentioned not returning our investment until 'the appropriate interest was gained' that was something Julie Moya told me in an email, justifying why they wouldn't return our money. The contract is public record if you look online at the court link provided. Julie told me in an email that 'the corporation is in control of our money' (paraphrasing here - have to recheck email for exact verbage) as they state that we were only shareholders in their corporation. However, if we were only shareholders (which we weren't) then we should have been allowed to see documents pertaining to our investment but we were never allowed to see any documents pertaining to how Moya used our money. (We also alleging that Moya isn't even allowed to offers securities in our state).

Anyhow, our contract stated that our money was to be used as a deposit for a specific property that we were to be partners in converting into condos. For months, Moya told us that the condo conversions were almost complete and we would be able to sell them shortly. However, we eventually found out that Moya never in fact completed the purchase of the building in question nor will Moya show us how he used our money nor has he paid us back our $160,000.

Actually I'd love more publicity, I'm trying to get it in the papers as it's my opinion that there are more investors out there that need to know the truth.

I thought about this too.

So many times you read that people "can't discuss" something even if there might be litigation. I never understood why exactly, I could probably reason through it. Maybe it depends on the type of case or something. Just seems like when "lawsuit" is mentioned, both sides are ordered to clam up.

I wonder if there's a lawyer or paralegal around that could explain why?

Maybe either side doesn't want to divulge their strategy? I just want to expose the truth. There are certain things that I am holding back however, that I'm only willing to divulge to the authorities. There's no need to discuss everything just yet.

My whole reason for being so vocal is to make this public so that other investors or potential investors can make informed decisions.
