That's absolutely horrible. I'm glad they survived and the guy was caught. I hope they don't suffer any permanent injuries. I'm very sorry OP, but I'm currently in no financial possition to make a donation. However, I will keep them in my prayers. Seems like they should be able to get some sort of state assistance if their medical bills are way beyond their means. They might want to check into that. Good luck and God bless!

Unfortunately, they only booked the jerk on a Misdemeaner charge & let him go after a couple of hours (bailed out). We are concerned about freezer meals to last for a long time as well as other means of living that are now cut off as work is being missed. It's been a complete heartbreaking nightmare for all of us here. Please continue the prayers / positive thoughts & again, thank you

That doesn't sound right that he was let off on a misdeameanor. We just had a case locally where a Va Tech student will be serving over a year in jail and five years probation for basically doing the same thing. She was drunk and text messaging and swerved into a crowd and injured six or seven people.

Seems like the person who hit your son and his girlfriend -- the driver's insurance should be taking care of all these expenses. And if he didn't have any insurance, I'd be seeing an attorney and getting his money from him some way or another.

Was the girlfriend pregnant? If so, then the driver of the car would be charged with murder or manslaughter in the death of the baby.

I would be asking a lot of questions and getting some answers. The article you linked sure sounded like the police weren't taking this accident very seriously. Plus the guy's a habitual offender.

I hope everything works out for your son and his girlfriend.

I'm sorry this happened to your family. If you haven't spoken to a lawyer you may want to on your son's behalf. Especially if it looks like they are going to be out of work for some time. I agree that the guy's insurance should pony up. Looks like that truck was pretty new, so he *should* have full coverage on it if he had a loan on it

I agree, it certainly does appear that the police are doing very little. The detective keeps reassuring us that things are being taken care of, yet they tell the television reporter that it's a misdemeaner. I am sooo freaking tired of all the run around. My son lost his unborn baby & on his birthday at that because of what just happened. There will probably be an attorney in this, but even so, the hospital bills & his fee will be huge, it could take years on top of that & the kids need help now with groceries, bills, etc... I am just sickened

I hate to say it, but it depends on the laws of the state and when they caught the driver. If they caught him some time after the accident and the toxicology tests were normal at that time that impacts the charges. It really depends on what kind of hard evidence the police have and how they build their case.

The sister of a friend of mine was killed by a hit & run drunk driver while crossing a street, but since the police didn't catch him until a few days later and couldn't 'prove' he was drunk at the scene he got a much lesser charge (I think it was tampering with evidence and fleeing the scene of a crime).

I was curious if there is a donation site in just the girls name as well so I could make a donation to her too?
I understand they were GOING to get married.. and might still.. but she needs her own fund as well.


Also- I am trying to understand their current condition. The article says your son is in fair condition, his fiance is stable.. you mentioned wheelchairs..

Thank You. The site was set us under Jay's name because she was in critical care & the bank we went to refused to have her name on there without her social security number & with the condition she was in, (they were hurt pretty badly) she could not give any kind of information out, so we just kept it in his name, they know it's for both of them & they live together, combine their incomes together, etc...
I am not allowed to mention much on their conditions right now because the detectives will be furious, but I will say they have made it past the critical part.

May I also suggest you (your lawyer) contact your son and his girlfriend's car insurance provider?
If the person that hit them has no ins then thier own "uninsured motorist" coverage will cover them as pedistrians being hit by an uninsured driver.
I was a pedistrian walking on a sidewalk once but none the less hurt due to an uninsured driver in a car so I know that can be done.

No matter which insurance, the drivers or the pedistrian's be VERY careful about endorsing any checks. The victums do not want to mistakenly sign something and later find out signing made the payments final forever.

I hope they heal as soon as possible.

My thoughts and prayers are with your family. Unfortunately I know firsthand what you're going through. Be sure to get in touch with a social worker at the hospital where your son and his girlfriend are. Hospital social workers are very experienced regarding the hospital bills, insurance, etc., and can be very helpful.

I'm so sorry for all that you and your family are going thu.

Have or has anyone told you about the victim fund ? I'm not 100% sure if this is for any victim or just the ones that are murdered, But worth looking into just the same.Also check to see about a social worker at the hospital and if they have any kind of funding.

I pray that with each passing day, things are getting better.
I have been following the KSL website, and I have read some of the horrible things that haver been said. I am so sorry that you are having to go through this. I just wanted to reach into my computer and yank those yahoo's back to realiity for you!!

Thank You. My son was not insured, he was walking on a sidewalk & no vehicle. Hopefully we can get some laws changed somehow, can you believe a freaking misdemeaner for the loss of their unborn baby & they in wheelchairs???!!! UGH!!! Each day is a new challenge, but we're all trying to be strong, it helps alot to read your positive comments. Thanks again & (((HUGE HUGS)))

His dad (your dh?) mentioned that he has insurance, they just won't cover this incident...then someone else came back and said to check to see if his vehicle insurance would cover this accident (maybe for uninsured motorist? not sure if that slimeball was insured or not.. I never saw that in the forum). But I am wondering, if your son has auto insurance, did you all call just in hopes that maybe they will cover some of the medical bills?

Did the slimeball have insurance? Please tell me he did....

Still praying for you and your family and I think about you all quite often.

What a terrible thing to happen! I think you should schedule a consultation with a lawyer. The fee will be minimal and having one will help your son get a better settlement from the man's insurance company - I hope he has one. Have you looked up Medicaid? It seems like if your son has no money, they could pay the medical bills if the man doesn't have insurance. The Victim's Compensation fund will pay some bils when the man is brought to court but there'll be a cap. You can find out about it if you call your solicitor's office. A lawyer can help you push for a more serious charge against the driver because causing the death of their baby while under the influence ISN'T a misdeameanor. I hope your son and the girl make a full recovery!
