Still missing a W-2........what to do?

We were issued W-2s and then got a phone call a few weeks later that they were wrong. Looking at the last pay stub, no, they do NOT match, so, yes, the W-2 is wrong. We were told they would be sent out by last Tuesday...... then by last Friday. Now, we are being told it will by by NEXT Friday the 20th of February, there is some kind of error, not sure if the machine or what???

Anyway, is there anything we can do??

It might be easier to wait until the 20th and find out if the employer did mail them.

Call the payroll department first and gently but firmly remind them that federal law requires you to have a correct W-2 in hand by February 2nd. I am responsible for issuing them myself and mistakes do happen, but they have an obligation to get it to you on time.

Please don't be rude, but make it clear that you need to file your taxes and they are preventing you from doing so. Keep a log of dates/times/people you talked to. If they don't respond and you casually mention that you'll need to contact the IRS, they'll pick up the pace and get it to you.

To make a long story short, except to keep calling and asking about it, there is nothing you can do.
The IRS says they have to be in hand by a certain date but really has no way to enforce it.

One year my employer heald all W2s and you were supposed to go to the office and pick them up. However, I was a remote employee several states away so it really wasn't possible for me to pick it up. I asksed them to mail it and it got lost the first time. By the time it was reissued and mailed, the postage rate increased so it was returned for insufficient postage and sat it someone's office for awhile. I didn't end up getting it until sometime in March <ugh>.
